Welcome to CH8 (the "App"), a secure messaging and communication platform. These Terms of Service ("Terms") govern your access to and use of our App, including all related features, services, and content.By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our App.

1. Acceptance of Terms

By creating an account and using our App, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy. You represent that you are of legal age in your jurisdiction to form a binding contract with us. If you are under the legal age, you must have your parent’s or legal guardian's permission to use the App.

2. Our Service

The App provides a secure communication service that includes:

• Secure Messaging: End-to-end encrypted text messages.

• Encrypted Calls: End-to-end encrypted voice and video calls.

• Secure File Sharing: The ability to share files, including images, videos, music, and documents, with end-to-end encryption.

• Cross-Platform Compatibility: The App is available on various platforms, including iOS, Android, and desktop devices.

We are committed to providing a secure and reliable service. However, we cannot guarantee that the App will be available at all times, as service may be interrupted by factors outside our control, such as network outages or maintenance.

3.User Responsibilities and Conduct

As a user of our App, you agree to the following:

• Account Security: You are responsible for keeping your device and your account secure. Do not share your phone number or account information with others. If you believe your account has been compromised, you must notify us immediately.

• Lawful Use: You agree to use the App only for lawful purposes. You must not use the App to transmit any content that is illegal, defamatory, harassing, hateful, obscene, or otherwise objectionable.

• Prohibited Activities: You must not engage in any of the following activities:

  • Sending spam, unsolicited messages, or any form of bulk messaging.
  • Distributing viruses, malware, or any other malicious code.
  • Impersonating another person or entity.
  • Attempting to gain unauthorized access to our systems or other users' accounts.
  • Using the App in a way that could damage, disable, or impair our services.

• Compliance with Laws: You are responsible for complying with all local, national, and international laws, rules, and regulations that apply to your use of the App.

4.Your Content and Data

• Ownership: You retain all intellectual property rights to the content you create and send through the App. This includes your messages, files, and any other data you transmit.

• End-to-End Encryption: We do not have access to the content of your communications, as they are protected by end-to-end encryption. We do not store your messages or files on our servers after they have been delivered.

• License to Us: To operate and provide our services, you grant us a limited, worldwide, non-exclusive, royalty-free, and sublicensable license to use, reproduce, distribute, and display the non-content data you transmit (e.g., your profile name and picture). This license is solely for the purpose of operating, improving, and providing our services.

5.Intellectual Property

All intellectual property rights in and to the App, including but not limited to all copyrights, trademarks, logos, and software, are the exclusive property of CH8 or its licensors. You may not copy, modify, distribute, sell, or lease any part of our App without our prior written consent.

6.Disclaimers

• "As Is" Basis: The App is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the App's reliability, availability, or suitability for any particular purpose.

• No Warranty of Security: While we use end-to-end encryption and robust security measures, we cannot guarantee that the App will be completely free from security breaches. You use the App at your own risk.

• No Warranty for Third-Party Content: We are not responsible for any content or services provided by third parties, even if they are linked to or integrated with our App.

7. Limitation of Liability

To the maximum extent permitted by law, in no event shall CH8 be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the App, even if we have been advised of the possibility of such damages.

8. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and without notice to you, if we believe you have violated these Terms. You may also terminate your account at any time by deleting the App from your device and following the account deletion process within the App's settings.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [UN Charter, principles of non-intervention, human rights law, and Nepal cyber security framework Act (ETA) of 2063 (2008)], without regard to its conflict of law principles. Any disputes arising out of or related to these Terms shall be resolved exclusively in the courts of visitors respective locations Jurisdiction.

10. Changes to the Terms

We may revise these Terms from time to time. We will notify you of any material changes by posting the updated Terms on this page or through an in-app notification. Your continued use of the App after the effective date of the revised Terms constitutes your acceptance of the changes.
